california is ban on same- sex marriage. california voters approved the ban in 2008, but challengers argued that the 14th amendment guarantees " equal protection ". they say that the finding marriage is only between a man and a woman violates their equal rights. today's oral arguments come as a new poll finds that the majority of americans now support same-sex marriage. >> ahead of today's hearing, thousands of people marched and rally in san francisco. the march started at castro and market streets at about 6:30 p.m. last night. activists said that they're optimistic that altman ruling of the supreme court will go in their favor. especially now that a new

the opponents of proposition a, which will be the attorneys for the couples that filed the original challenge, will get with the minister argued that the ban is unconstitutional. the final 10 minutes are reserved for the u.s. solicitor general who will argue against proposition 8 on the behalf of the obama administration. a final ruling will be handed down in june. >> strong sentiments on both sides of this issue. rene marsh joins us this morning live from washington d.c.. >> of course, the challengers to up proposition 8 argue that this is a violation of the 14 the mimic. they stated that this violates the equal

>> more americans than ever before said they have a family member or a close friend who is gay or is a lesbian. that corresponds with an increase in the number of americans who are now supporting gay marriage. a new cnn in international survey finds that 57 percent of americans reports someone close to them is gay or lesbian. that is well points higher than the poll results were in 2007. the number of people supporting same-sex marriage has jumped from 40% in 2007 to 53 percent today. >> we did experience some sprinkles on over night mainly in the north bay area. if the temperatures are not too bad. it is 40

perot's camp. there is more sunshine today than what we saw yesterday. we do have some sprinkles that are out. hayward is at 53 degrees and it is 49 degrees in mountain view. it is low 40's and walnut creek. as we look at the numbers for the afternoon we have plenty of 67 or around. the temperatures are not as chilly as what we saw yesterday. we are still seeing fremont as 62 degrees and 67 degrees will be the high for fairfield. 59 degrees will be your high for downtown san francisco. it will be mid 60's for santa rosa and 564 ocean beach. we did have moisture overnight and a weak system
